If a couple has separated and were married, they need to apply for a divorce through the Australian Family Court. The divorce application can be made individually or jointly and can be submitted after being separated for one year and one day. If a couple is married for less than two years, they must attempt marriage counselling before a divorce application can be filed.
Divorce applications must set out what arrangements are currently in place for the care and welfare of children born to the marriage or children born to earlier relationships as the divorce order will not be granted if the court is not satisfied that those arrangements are appropriate. These arrangements include: the time which the child/children spend with each parent, schooling, health and financial support.
Formal court proceedings for property settlement must have commenced within 12 months of a divorce. The court can grant permission to commence proceedings outside of this time but permission will not be granted if the court cannot be convinced that there is a reasonable excuse for the delay, which will result in financial hardship.
